In preparation for his much-anticipated arrest this week on charges related to a probe into a $130,000 (£106,000) payment to porn star Stormy Daniels in 2016, Donald Trump has holed up in Florida.
He would be the first president of the US to be charged with a crime.
Here are some substantial questions about the relevant issues in this case.
What is Trump accused of?
Stormy Daniels, a celebrity of the adult industry, contacted media outlets in 2016 and offered to sell her account of what she claimed to be an adulterous liaison she had with Donald Trump in 2006.
When this was discovered by Trump’s team, his attorney Michael Cohen gave Ms. Daniels $130,000 in exchange for her silence.
This is not a crime. However, the payment record indicates that Trump reimbursed Mr. Cohen for legal fees. According to the prosecution, Mr. Trump has engaged in business record falsification, which is a misdemeanor and a criminal offense in the state of New York.
Because his attempt to conceal his payments to Ms. Daniels was driven by a desire to keep his relationship with her a secret from the public, prosecutors can also claim that doing so violates election law. Falsifying records to conceal a crime is a more serious offense that would be charged as a felony.
That this is by no means a straightforward case is acknowledged by even prosecution supporters. There is scant precedent for such a prosecution, and previous attempts to hold politicians accountable for blurring the line between campaign funding and personal expenditures have failed.
Former financial prosecutor for the New York City district attorney Catherine Christian predicts that the situation would be difficult.
What happened between Stormy Daniels and Donald Trump?
Stormy Daniels goes public with affair claim
Stephanie Clifford, a.k.a. Ms. Daniels, said in media interviews that she first met Trump in July 2006 at a charity golf outing.
She claimed something happened to her and Trump in his hotel room once while vacationing in the ski resort of Lake Tahoe, which is located between California and Nevada. This was “vehemently” refuted at the time by Mr. Trump’s attorney.
She responded to the interviewer’s inquiry about whether Trump had advised her to remain quiet about their alleged night together by saying, “He didn’t seem worried about it. He was kind of arrogant.”
Melania Trump, the current spouse of Trump, had just given birth and was not present at the tournament.
Threats and payments to stay silent
Days prior to the 2016 US presidential election, Ms. Daniels claimed Michael Cohen, the attorney for Trump had given her $130,000 in “hush money” to prevent her from disclosing the affair.
