The warning was made Wednesday to the Senate subcommittee on space and science during a hearing on commercial space laws by William Gerstenmaier, vice president for build and reliability at SpaceX who previously held the position of associate administrator for human exploration at NASA.
The comments come at a time when SpaceX’s intentions to launch its giant moon rocket once more from the company’s facilities in South Texas are being reviewed by the Federal Aviation Administration and the Fish and Wildlife Service for their potential impact on the environment.
After its first test flight in Texas earlier this year, the company’s Starship rocket and spacecraft system, which is being developed in part to land astronauts on the moon for NASA’s Artemis program, exploded.
Gerstenmaier added that although SpaceX has been prepared for a month to launch the following Starship test flight, “it’s a shame when our hardware is ready to fly and we’re not able to go fly because of regulations or review.” “Licensing, which includes environmental (evaluation), frequently requires more time than rocket development. Nothing like this ought to occur. Likewise it only gets worse.
In addition, he asserted that the delays in regulatory compliance have “nothing to do with public safety.”
Discussions about the regulatory environment, according to Gerstenmaier, are crucial “in the face of strategic competition from state actors like China.”

The FAA, which was not represented at the hearing, stated in a statement on Wednesday that keeping up with industry demand was a top priority and crucial for many reasons, including addressing our needs in terms of national security and civil exploration.
In an effort to beat China’s own moon base plans, NASA’s Artemis program seeks to send people back to the moon’s surface for the first time in more than 50 years.
Over its maiden test flight, SpaceX encountered opposition. In response to the incident, a group of environmental activists filed a lawsuit against the FAA, claiming that by approving the launch, the agency violated environmental regulations.
For its part, SpaceX has long argued that rocket explosions during the early stages of development are beneficial since they provide for faster design feedback than ground tests.
Gerstenmaier did admit that in addition to regulatory obstacles, SpaceX is still having trouble with technology as it develops the Starship. It’s still unclear whether SpaceX will be able to reach NASA’s target of having Starship prepared for a lunar landing by the end of 2025.
